LABOUR LAW IN ROMANIA: ESSENTIAL FIGURES

 

The need to draft internal regulations:

  • as of 1 employee upwards

The need to commence negotiations for a collective employment agreement:

  • as of 21 employees upwards

The need to have one representative of the staff:

  • as of 21 de employees upwards

The notice period in case of independent dismissal of the employee:

  • at least 20 business days

The notice period in case of resignation is:

  • 20 business days for executive positions
  • 45 business days for management positions

The minimum duration of paid vacation is:

  • 20 business days

The maximum duration of a contract with limited term is:

  • 12 months, renewable twice, i.e. 36 months in aggregate

The normal duration of one business day is:

  • 8 hours

The maximum duration of the probation period for contracts with unlimited term is:

  • 90 calendar days for executive positions
  • 120 calendar days for management positions

The maximum duration of the probation period for contracts with limited term is:

  • 5 business days if the contract term is below 3 months
  • 15 business days if the contract term is spanning between 3 and 6 months
  • 30 business days if the contract term is longer than 6 months
  • 45 business days if the contract term is longer than 6 months and refers to a management position

The minimum duration for a part-time day is:

  • There is no longer a minimum duration
