The Health Insurance Fund or employer can monitor the employees who are on sick leave

Monitoring sick leave

The Romanian government states that employees on sick leave must submit to home monitoring:

  • by their employer (for the first 5 days),
  • or by the Health Insurance Fund- the CNAS (on the 6th days of prescribed sick leave).

When applying for sick leave, the patient must fill out a declaration specifying:  

  • that he or she agrees to notify the employeer within 24 hours of obtaining the sick leave certificate;
  • the doctor's information;
  • the address where he or she will reside during the sick leave;
  • the he or she will remain at the stated adress, except in situations justified by medical documents, so that he or she can be checked on as prescribed by law between 8:00 – 11:00, 12:00 – 17:00 , 18:00 – 20:00
  • that he or she agrees not to receive payment for sick lave if the above conditions are not met.

Representatives of the pay agency (employer or CNAS), accompanied by a police officer (if necessary or if requested), go to the address that the employee indicated to verify the patient is there, but are not allowed to enter the home.

After the visit, a report is written up. If the result is negative, pay for sick leave is suspended the day after the report is submitted.

On the sixth day of sick leave the patient is transferred to the list of sick leave employees on the CNAS, and the employer stops paying and the Health Insurance Fund starts paying.

In accordance with the law, doctors who prescribe sick leave abusively can receive fines from 2,500 LEI to 10,000 LEI.

The law states that a family doctor (generalist) can prescribe up to 30 days maximum of sick leave. Only specialists can prescribe more than 30 days.
