The company must negotiate a collective employment contract once they have:

  • 21 employees

  • 21 employees

A company must draft its rules of procedure even if there is just:

  • 1 employee

Minimum number of days notice in case of lay off:

  • 20 work days

Number of days notice in case of resignation:

  • 20 work days for non-management positions
  • 45 work days for management positions

Minimum number of vacation days:

  • 20 work days

Maximum duration for a short term employment contract:

  • 12 months. It can be extended twice for a total of 36 months

Number of hours in a normal work day:

  • 8 hours

Maximum trial period for an employment contract (indefinite period):

  • 90 calendar days for non-management positions
  • 120 calendar days for management positions

Maximum trial period for short term employment contracts:

  • 5 work days for periods less than 3 months
  • 15 work days for periods between 3 and 6 months
  • 30 work days for periods longer than 6 months
  • 45 work days for managment positions longer than 6 months

The minimum duration of a part time work day is:

  • no minimum

Please note: collective agreements (national, by sector or by company) can deviate from these rules but must adhere to the minimums laid out in the labor code.
